TERMS AND CONDITIONS OF SALE

Article 1 - Seller’s Identity

Article 2 - Scope of Application

These General Terms and Conditions of Sale (GTC) govern all distance sales between COUSSAINT (hereinafter “the Seller”) and any consumer buyer (hereinafter “the Customer”) placing an order via the website www.coussaint.fr.

Any order implies full and unconditional acceptance of these GTC. These GTC take precedence over any other document, unless the Seller expressly waives this in writing.

 

Article 3 - Products

COUSSAINT offers a range of Christian home décor items (embroidered cushions, framed photographs) designed according to the brand’s own designs and mass-produced by selected suppliers. Products are identical from one customer to another for the same model.

The photographs and images presented on the website accurately represent the products. Slight variations in color due to screen calibration or material characteristics may occur and do not constitute a defect in conformity.

COUSSAINT reserves the right to update its collections (models, colors, materials) without prior notice. Products are sold while supplies last.

 

Article 4 - Prices

Prices are listed in euros (€), inclusive of all applicable taxes in France. The Seller reserves the right to modify its prices at any time, without prior notice. Orders are billed at the price in effect at the time of confirmation.

For deliveries outside the European Union (particularly to Africa), customs duties, import taxes, or other local levies may apply. These costs are the sole responsibility of the Customer and are beyond the control of COUSSAINT.

 

Article 5 - Ordering and Confirmation

The ordering process is as follows:

  • The Customer selects products from the online store

  • The Customer reviews the shopping cart and enters their contact information and shipping address

  • The Customer selects a payment method and completes the payment

  • An order confirmation email is sent within 24 hours of payment

 

The sale is deemed concluded upon receipt of this confirmation email.

 

Article 6 - Payment

Payment is due in full at the time of ordering. COUSSAINT accepts the payment methods offered by its platform (credit card, PayPal, or any other method indicated during the checkout process).

Payment data is processed by a secure service provider. COUSSAINT does not retain any of the Customer’s banking information.

 

Article 7 – Processing and Delivery Times

7.1 Processing and Shipping Time

Since COUSSAINT products are mass-produced by a third-party manufacturer, a processing period and transit time to our warehouse are required before shipment. This period is approximately 4 to 6 weeks from the date the order is confirmed, unless otherwise indicated on the product page or at the time of ordering.

This timeframe is provided for informational purposes only. COUSSAINT undertakes to notify the Customer by email in the event of a significant delay and, if applicable, will offer the Customer the option to cancel their order and receive a full refund.

7.2 Delivery Times

Once your order has been shipped from our warehouse, the estimated delivery times are:

  • Mainland France: 2 to 5 business days

  • Europe: 5 to 10 business days

  • International (Africa, rest of the world): 10 to 21 business days

 

These delivery times are approximate and may vary depending on the carrier, customs procedures, and periods of high volume. COUSSAINT cannot be held responsible for delays caused by carriers or customs authorities.

7.3 Order Tracking

A notification email is sent to the Customer upon shipment, including a tracking number that allows the package to be tracked in real time.

 

Article 8 - Right of Withdrawal

8.1 Principle and Time Limit

In accordance with Articles L.221-18 et seq. of the French Consumer Code, any consumer customer has a period of 14 calendar days to exercise their right of withdrawal from the date of receipt of their order, without having to provide a reason or pay any penalties.

Since COUSSAINT products are mass-produced according to the brand’s own designs (and not according to specifications specific to each customer), they are not subject to any exceptions to the right of withdrawal. This right therefore applies in full.

 

8.2 How to Exercise Your Right of Withdrawal - Compliance with Order No. 2026-2

Pursuant to Order No. 2026-2 of January 5, 2026 (Article L.221-21 of the Consumer Code), COUSSAINT provides its Customers with a free and accessible feature allowing them to exercise their right of withdrawal directly online.

There you will find an online form that allows you to:

  •  Identify your order (order number + date of receipt)

  •  Specify the product(s) in question

  •  Express your decision to cancel

  •  Automatically receive a time-stamped acknowledgment of receipt via email

A time-stamped acknowledgment of receipt will be sent to you immediately.

 

8.3 Effects of Withdrawal and Refund

In the event of a valid withdrawal exercised within the 14-day period:

  • The Customer must return the product(s) to COUSSAINT within 14 days of deciding to withdraw, at their own expense, unless COUSSAINT has failed to inform the Customer that they are responsible for these costs

  • The products must be returned in their original condition, complete, and properly protected for shipping

  • COUSSAINT will issue a full refund of the product price (excluding return shipping costs) within 14 days of receiving the returned products or proof of shipment, using the same payment method used for the order

 

COUSSAINT reserves the right to deduct from the refund any loss in value of the product resulting from handling other than that necessary to determine the nature, characteristics, and proper functioning of the product.

 

8.4 Other Cases of Refund

Apart from the right of withdrawal, COUSSAINT undertakes to find a solution in the event of:

  • A product received that is defective or damaged during shipping

  • A product that does not match the order placed

  • A package that is lost or not delivered within a reasonable timeframe

 

The Customer is asked to contact COUSSAINT at contact@coussaint.fr upon receipt, attaching photographs of the product in question.

 

Article 9 - Legal Warranties

In addition to the right of withdrawal, the Customer is entitled to the following legal warranties:

  • Legal warranty of conformity (Articles L.217-4 et seq. of the Consumer Code): 2 years from the date of delivery of the goods

  • Warranty against hidden defects (Articles 1641 et seq. of the Civil Code)

 

In the event of a lack of conformity, the Customer may request repair or replacement of the product, or, failing that, a price reduction or termination of the contract.

 

Article 10 - Article 10 - Returns and Refunds

In cases where a return is accepted by COUSSAINT (Article 8.4), the procedure is as follows:

  • The Customer must contact COUSSAINT by email at contact@coussaint.fr before sending any items back

  • COUSSAINT fournit un bon de retour ou des instructions d'expédition

  • The product must be returned in its original packaging or equivalent, properly protected

  • The refund will be issued within 14 days of receipt and approval of the return, using the same payment method used for the original order

 

Return shipping costs are the Customer’s responsibility, unless the return is due to a proven error on the part of COUSSAINT.

 

Article 11 - Liability

COUSSAINT shall not be held liable for any indirect damages resulting from the use of its products, nor for any delays or damages attributable to carriers or the customs authorities of third countries.

In the event of force majeure (strike, natural disaster, pandemic, serious disruption of transportation, etc.), COUSSAINT’s obligations shall be suspended without compensation.

 

Article 12 - Intellectual Property

All content on the COUSSAINT website (photographs, text, logos, product images, embroidered designs) is protected by copyright and remains the exclusive property of COUSSAINT. Any reproduction, even partial, is prohibited without prior written permission.

 

Article 13 - Protection of Personal Data

The data collected during the ordering process (name, address, email, phone number) is processed by COUSSAINT solely for the purposes of processing and tracking orders, in accordance with the General Data Protection Regulation (GDPR — EU Regulation 2016/679) and the French Data Protection Act.

The Customer has the right to access, rectify, erase, and object to the processing of their data by contacting contact@coussaint.fr. No data is transferred to third parties without the Customer’s explicit consent.

 

Article 14 - Mediation and Dispute Resolution

In the event of a dispute, the Customer is encouraged to first contact COUSSAINT at contact@coussaint.fr to seek an amicable resolution.

If an amicable solution cannot be reached within 30 days, the consumer Customer may seek the assistance of an accredited consumer mediator free of charge. To find a qualified mediator: www.economie.gouv.fr/mediation-conso

Article 15 - Governing Law

These Terms and Conditions are governed by French law. Any dispute that cannot be resolved amicably shall be subject to the jurisdiction of the French courts.

 

Article 16 - Amendments to the Terms and Conditions

COUSSAINT reserves the right to amend these Terms and Conditions at any time. The applicable version is the one in effect on the date of the order. Customers are encouraged to regularly review the Terms and Conditions page on the website.
